A retired electrician in northwest Ohio, who contracted an asbestos-related cancer called mesothelioma, recently won his case on appeal to Ohio Court of Appeals. The panel on the Court ruled that a Cleveland Ohio trial court judge committed error in dismissing Lee C. Rettig's lawsuit against General Motor's Corporation after siding with Rettig's attorney who argued that GM was aware of the dangers of asbestos and had a duty to warn Mr. Rettig.
According to toledoblade.com:
Mr. Rettig contends that he contracted mesothelioma, a fatal lung cancer almost always caused by asbestos, on the job from exposure to asbestos-containing steampipe insulation and wiring.
The case will now be sent back to the Cuyahoga County Common Pleas Court to continue the case for final adjudication and resolution. Maybe this time around this mesothelioma sufferer will get the just compensation he deserves for having been knowingly been exposed to so much asbestos containing material both in and around his work place over the 40 something years he worked there.
